All should be under RTI Act

I agree that Private Sector, Public Sector, Engineering and other commercial social federations all be under RTI Act. Also their profits be based on ABC (average business cost) social audit. There should be a mechanism too wherein all these are forced to spend C.S.R. funds are spent for the purpose these are earmarked and are not just donated to political parties. CSR should be under proper audit.

Why are PS not sent back to their cadre ?

IAS officers get posted as PS and OSD to Ministers when they are in the grade of Dy Secy and Director. IAS as Secretary, the head of the department and as the PS to the Minister -the power is retained and confirmed that Minister does not act against the interests of this service. Why are the PS not sent back to their cadre instead of being adjusted in Delhi.

Good suggestion
Very good suggestion by Naveen. Unfortunately neither the Politicians nor the vested interested Bureaucrats will allow such transparency. The crux of the problem is in the opaque process of selection/appointment of senior positions in Government/PSU/ Banks and other institutions. In addition there should be clearly laid down accountability at each level of bureaucracy. Strict monetary punishment for failure to do a task/causing unnecessary harassment to an individual should be made part of conduct rules.

Salaried class to loose their peace of mind

If Piyush Goel becomes Finance Minister, just like dynamic fare being under implementation in railways affecting the commuters, a special tax system like dynamic tax will be imposed on middle class especially on salaried class apart from the usual tax they are paying and force the middle class and salaried class to loose their peace of mind and keep them in tension.

Why people Abuse?
It is giving vent to uncontrolled anger caused by deep emotion of jealousy. It is the indication of frustration which can lead to brain attack unless released immediately. The frustrated guys feel weak and helpless against their enemy. They are deeply jealous of their enemy. Unable to harm him physically, they resort to abuse to destroy him emotionally and mentally. If the enemy turns out to be mentally stronger than them, the abusers go wild and resort to savagery. However, they are losers all the way since they only denigrate their own parents for poor brought up and poor education. Their mind is filled with uncontrolled negativity. It fouls their vocabulary. They hate to use positive expressions and take others as weak or coward for not responding to their provocation violently. They aim to provoke the target to fall down to the level of their street language, evil or “gunda” expressions. By nature, they are “khal” or malicious ones. Their target ignores their malicious words or speech the same way a graceful mountain bears the severity of the rain drops. When these khal grow into Dusta or demonic, they need to be punished. It is no use trying to persuade the dusta because they can only be vanquished. The entire justice delivery system is meant to punish the dusta. The vilification carried out by the political parties and their leaders in the past two months also betrays their feudal psyche. Before coming into force of the constitution of India, it used to be their normal day to day pattern of behavior. They would go about hitting, abusing or denigrating the poor. Even if they murdered a doctor in a hospital or public servant they would manage to escape the gallows. Feudal lords used to abuse, torture, terrorise, punish, burn alive or subject to various other atrocities the poor citizens whom they denied the idea of a citizen, not to talk of any rights. Till the ugly Emergency of 1975, the people were not fully conscious of their rights. The Emergency jolted them. And the first thing the feudal mind (rather “thought police” in Orwellian speak) thought of was citizens’ “obligations”, which were included in the constitution. Our Netas have no obligation to the voters! The abusers were made to realize the power of the Rule of Law over their feudal conduct after 1950. It created conflict, which though reduced, still continues. The abusers, the gang rapists, the chief ministers making fun of the constitution by proclaiming that they do not recognize Modi as the prime minister, the ministers who behave vulgar and indecent under the misconception that they are above the law, are warts on democracy and Rule of Law and need to be taught a few lessons in decent and civilized democratic behaviour. The Supreme Court of India has done a great service as well as a disservice by its judgement in the S.R.Bommai case and ought to review it on their own to tame such recalcitrant feudal elements, violating the law, and to put the fear of law into their swollen heads in the interest of Rule of Law and democracy. Every single abuser of Narendra Modi is guilty of that feudal mindset, which is currently posing the biggest Challenge to Rule of Law and Threat to Democracy. Every such person needs medication and psychiatric support beside heavy dose of law. None of these abusers is anywhere near the stature of Narendra Modi which he has earned by sheer dint of his hard work. Public service has been made a dhandha or commercial opportunity by these unscrupulous elements in politics, who have revived the culture of might is right by resorting to violence. Narendra Modi is the only hope of the people to retrieve public service from their clutches and put it on the high pedestal our freedom fighter leaders had placed on. They inspired the people to sacrifice their personal interest in the service of the people. Can any of Modi’s detractors claim to be so? Can they say they have not acquired illegally huge assets at the cost of public interest? Even one among the mahagathbandhan?

Bring private organisations also under the ambit of the RTI Act
The private organisations should also be brought under the ambit of the RTI Act. When a government bank is answerable under RTI, why should a private bank be given the privilege of being out of it ? Are they not working in identical circumstances ? In fact, the PSUs have to face so many committees while the private sector has no such control. A Public Sector electricity distribution company is answerable under RTI, the same norm should be applicable to a private company too.

Are elections really a celebration of democracy ?

At least Elections 2019 cannot be termed as celebration. The word "celebration "is akin to something joyful. You celebrate when you are happy and in festive spirit. What we are going through is not a festival but street fights where abuses of the worst kind are hurled at each other. Truth is a victim of blatant shameless lies as part of strategy to win votes. Even those long dead are not spared. If naming them hurts your rival. Your whole khandan is being invoked with real or imaginary wrongs done by them. The noise is getting on one's nerves and what a prolonged torture it is. One waits for !9th May when one is spared of this onslaught on one's finer senses and this abusive language would stop and we return to decent social behaviour.

Debate

DEBATE (1)
Huge no. of retd defence personnel eligible for Jt. Secy level post
Ex-servicemen should be given first priority in government re-employment as huge number of officers from all three services qualify for the post of joint secretaries. Isn’t it?
An Ex-serviceman
Transparency and honesty: Need of the hour (contd.)
Transparency and honesty are two main pillars in democratic system. Any working which is not transparent gives rise to suspicion and wrong doing with some exception. We are observing in many areas where public interest is involved but working is neither transparent nor honest. In financial working it is still more important. Banks NPA is rising due to non-transparent working. Lenders are not aware the exposure of other lenders in same project or organisation. Had it been transparent then cases like Kingfisher would not have happened. Still we can adopt of transparent working with honesty. The case of IL&FS has not been fully understood unless forensic audit is done. The exposure of different banks in other NBFC is not known due to non-transparent working. Let all the stressed assets/funds are brought in public domain to know the real situation or exposure of different banks. Power and Telecom are other sectors waiting to unearth stressed assets apart from real estates. The situation is not comfortable as many things are happening behind the curtain and are kept out of public domain in the name of secrecy and confidentiality. We should follow transparency and honesty in our working as far as possible without covering it under clause of confidentiality. Long term effect will always be good if it is followed. Now a days accountability is to be followed in our working. This is to be integrated into the working system so that the persons responsible can be brought to the book. Please integrate the transparency and honesty in the system.

Limited lateral entry good

DEBATE (1)
Limited lateral entry will prove to be a boon to control All India Service officers. It is said to have been brought in to make AIS officials efficient.

"Padharo Mhare Desh"
World’s largest democracy in action. Chaos, more chaos, perfect chaos. We live in the Animal farm. Accusations, counter-accusations, expletives by the political class. In absence of Parliament, all jibes, rhetoric are unparliamentarily. TV channel debates are one-sided. An air of despondency
PM Modi cites derogatory remarks uttered against him by the Opposition for invoking public sympathy. And, vice versa. Battle of wits continues in the name of Freedom of Speech and Expression.
All political parties are confident of winning majority. Battle of nerves .
PM Modi banking on pro-incumbency wave. His cheerleaders, blind followers are busy conducting their own opinion and exit polls. Ram Madhav of RSS claims he knows more than others, talking of receiving support from other parties.
" Thug-Bandhan " hopes for anti-incumbency tsunami, has its eyes set on anointing Mayawati as Prime Minister. Mamata didi usually behaves like head of a Republic.
The Congis are getting desperate with each passing day. Scared of ultimate liquidation of its dynastic monarchy. Diggy Raja trying to prove, he is a hindu , performing yagnas under camera glare to woo hindu voters.
PM Modi reveals Rajiv Gandhi's hypocrytic life-styles ,picnicking aboard the warship INS-Virat in Lakshdweep, accompanied by his Italian in-laws, sorry ,out-laws, jeopardising national security. But, Modi’s claim of Italian participation in picnics, is ruled out by former Naval chief Admiral Doss.
Judiciary is under attack. CJI faces sexual harassment charges, gets clean chit by the truncated panel of three SC Judges. Deeper conspiracy. People's faith in institutional integrity of Judiciary, is shaken. Corruption in the Bench and the Bar continues. Total trust deficit.
Recall George Orwell’s seven commandments in Animal Farm:
"Whatever goes upon two legs is an enemy.
Whatever goes upon four legs is a friend.
No animal shall wear clothes.
No animal shall sleep in a bed.
No animal shall drink alcohol.
No animal shall kill any other animal.
All animals are equal.”

Elections at Satara Branch of ICAI

The appellant sought information regarding the elections held at Satara Branch of WIRC of ICAI such as the copies of the explanations demanded by Secretary, ICAI from the returning officer while enquiring about his misbehaviour in conduction of election of Satara Branch of WIRC of ICAI along with copies of the clarifications given by the returning officer. The CIC observed that an improper reply has been provided to the appellant as in the reply of the CPIO, it has been stated that “since the re-poll was held at Satara Branch of WIRC of ICAI, no action in the matter was required”. The PIO was directed to provide a revised reply and was cautioned to remain careful while providing replies under the RTI Act.
Comments
Not only the general elections, but the elections of other public authorities have been the subject of RTI applications. While replying to an application, the PIO must address the specific issue raised by the applicant.

“Guard Against Accidental Bureaucrats ”

DEBATE (1)
In a first, nine private sector specialists were selected by the UPSC for appointment as joint secretaries in union departments under the Lateral Entry Mode. Competition was fierce as more than 6000 applications were received. Appointments were made in sensitive ministries like civil aviation , commerce, Economic Affairs, Environment, forest and climate change, Financial services, New and renewable energy, Road transport and highways, Shipping, Agriculture, Cooperation and farmers welfare. The authorities failed to assess the impact of purported decision on civil servants ? A walk-the talk across the corridors of power would reveal that taking hasty and ill-advised decision without consultation, has caused massive anguish and anger in Indian bureaucracy. Was the Committee of Secretaries consulted. If, not, why ?
It is time to place all relevant documents in the public domain to for sake of transparency. Silence of serving bureaucracy is baffling and shameful. Be that as it may, the Government will have much to explain.
Some questions are bound to crisscross the minds of informed citizens. Let us see, how ?
( a ) How could the authorities ignore massive heart-burnings, that the decision would cause among serving bureaucrats? Views of cadre-controlling authorities of all organized services should have been obtained for facilitating a holistic view . This was not done. It is understood that a coterie of favourite bureaucrats alone was consulted. Why?
(b) Will the initiative add value to Good governance ?
(c ) The general suspicion in the power corridors is that the UPSC was associated with selection process by way of a stratagem to lend the semblance of credibility and acceptability to the selection process.
(d ) Is the current dispensation dis-satisfied with the laidback bureaucracy ? Why, the trust deficit ?
(e ) Were comprehensive background checks of nine contractual appointees carried out ? This should have been imperative considering the sensitive assignments that the lateral entrants would be handling at the cutting edge level while holding extremely sensitive positions ?
(f) Will induction of private sector specialists into government mainstream bring about magical changes in country’s economic health like rise in GDP, reducing rate of inflation, poverty alleviation ?
(g) The nine domain experts from private sector are liable to manipulation by big business houses through policy formulation in their favour . This is not to cast aspersions on the merit of the executives. But,the moot point is that they are not trained to uphold the doctrine of bringing maximum good to maximum people. They are trained only to maximise profit for their employers, by hook or by crook. How could career bureaucrats belonging to different organized services take it lying down?
( h) Another important point. Once appointed as Joint Secretaries, they would be immune from investigation by the CBI without the explicit sanctions of competent Authority. The practice of taking approval of the Government for carrying out even preliminary investigation, was dismissed by the Supreme court .The status-quo- ante based on doctrine of Single Point directive, was quickly restored by overturning SC’s verdict by the Parliament. All political parties voted unanimously to reverse the Apex court’s verdict.
(i) No wonder, the contractual specialists hired for three years tenure , under political patronage could even be appointed as CVC or Director CBI. Institutional integrity is being willfully eroded. Ironically, the proverbial steel frame of bureaucracy, usually in Manmohan Singh’s mode, has learn by experience to be pliant and subservient to the political masters. It is spineless. Bound by Conduct Rules , it has no other option but to shut up and put up. Let them remain gutless and speechless in their own interest .
( j) Taking a cue from the Centre, States governments would be quick to install their protégées in bureaucracy. The new brand of committed bureaucracy will enjoy salaries, perks and privileges out of tax payers money as rewards for political loyalties.
(k) What are the safeguards against leakage of sensitive data and information from government files to the corporate lobbyists, media and foreign business and intelligence agencies?
Conclusion:
Absence of accountability and transparency will mean "fixed matches”. Irrespective of selection criteria, unwarranted interference by top business honchos and the political class in appointment of such “Accidental bureaucrats” cannot be ruled out. Corporate lobbyists, touts, fixers, brokers, will have a free run in the country. Decisions would be mired in “ Conflict of Interests” conundrums. Politicians have vested interests in nurturing and promoting the ‘committed bureaucracy’. Mutually beneficial. The elite bunch of high net-worth lateral entrants will have no fear of anti- corruption agencies. All exempted from pre-dawn raids by the CBI, ED, IT. Political patronage. No fear of tongue- lashing, threats and expletives by the political class. But, involving them in policy formulation without field experience is incomprehensible and ill-advised. They cannot be treated at par with members of organized services. No level playing field.
This is not to give a clean chit to the regular civil servants. The laggards and the corrupt among them must continue to be punished with major or minor penalties as per Conduct Rules. Repercussions of the ill-advised move will be visible soon. It will be too late for DOP&T &AR to carry out mid-course correction

Cabinet Form of Government or NAC Form ?
The Congress Party in its election manifesto has promised to revive the NAC (National Advisory Council). It was also discussed by it in the conclave of several opposition parties held last month at the Talkatora Garden in Delhi. Surprisingly, the Civil Society members, who have publicly appealed to defeat Narendra Modi, were present but never objected to this un-constitutional provision. The NAC was more than a full council of ministers headed by Sonia Gandhi as Chairperson. It had retired CJI, Judges, bureaucrats, members of the civil society and a secretary to the government of India serving it. It was a government over a government, a de facto government over a de jure one. Now, that is patently unconstitutional. But it worked for 10 years. It was a parallel government. It took decisions without any accountability. It had access to government files unofficially. It proved a point that a government can be run in India outside the constitutional scheme of things. It would be extremely unfortunate if the NAC ever again comes to rule India. In simple terms it means “outsourcing” government to unelected people. It means a “parallel government”. It means a licence to loot the country and its assets. It means establishing a black economy and parallel economy. It means corruption, scams and scandals. Worst of all, it means sabotage of the constitution of India. The UPA-I & II regime during 2004 through 2014 had proved it so dauntingly that there was no need for the constitution or the constitutional scheme of governance or a cabinet form of government because the NAC had worked much better than the cabinet form of government under Manmohan Singh. After all, people’s perception is that Manmohan Singh was no functional prime minister as it was indeed Sonia Gandhi. That fact can’t be easily controverted. The logic though is as contorted as the claim that the National Emergency (1975-77) did serve the people better as trains were run on time! Voters need to use their own sense of wisdom.

DEBATE (1)
This is not new initiative. Had it been at Secretary level, outcome would have been different. However, under existing hierarcy, JS works under AS/Secretary and as such, is a subordinate. He/she will be at the mercy of subordinates and sweetwill of seniors. This initiative can work if he/she is given free hand to choose a team of his like and report to Executive Head of the Ministry only. In this way, there will be no place for them to pass on the bucks on the lower staff or on his seniors for delay as he/she will be accountable and responsible for completion of project assigned to him/her.

“The global terrorist heightens Security threat to India”
Masood Azhar of JeM is now designated a global terrorist by the UNSC. India's unrelenting, tenacious pursuit with China merits commendation.
No doubt, a good news for us. But, why are people so ecstatic about it, one wonders. Will Pakistan hand over Azhar for trial in India on various counts? It is time for eternal vigilance. Instead of getting jubilant, India must guard against backlash terror attacks by the ISI, ISIS, other Pakistan-based radical tanzeems and their Indian modules. How far will Pakistan comply with UN sanctions, is yet to be seen. This is no time for counting political brownie points. No room for complacence. Let us prepare for the worst.
There is no dearth of terror groups in Pakistan. Someone will soon take over the mantle of leadership under the shadow of Masood Azhar who may or may not have a free run in Pakistan. But his venom-spewing videos will go viral like those of Baghdadi. Terror export will continue, unabated from the soil of " Naya " Pakistan.
India's security threat perception will be heightened in the coming times. Learn from history. We should never take China and Pakistan at their face value. With growing mistrust and their injured egos, the two neighbours will never take it lying down. India should get ready for more terror attacks as vendetta.
While hailing Indian diplomats, let us not undermine the role of three permanent members of Security Council : the US, the UK and France for their persistent efforts in forcing China to fall in line.
