Extension of retired bureaucrats is point of worry

Many top level bureaucrats get extensions again and again as if nobody cannot be equal to them in performance. All these bureaucrats performed as per the whims and fancies of the ruling governments. During the BRS regime nearly 15 retired bureaucrats got extensions again and again with fancy designations getting perks equivalent to ministers. This should be stopped and many young efficient persons in the respective fields are available. In Telangana , the new elected Government came to know that almost every body's top persons' phones were tapped ,even including judges. All these fallacies are due to unreasonable extensions of retired bureaucrats.

Explaining the meaning of the term “Relevant Trades”

The Appellant contended that in recruitment for WCS post, the selection criteria followed by Rajasthan and other states are controversial in nature since every CITS course has its own importance, yet instead of following uniform selection process, some states are making rules according to their choice which creates confusion. To clarify this controversy, he sought the eligibility criteria for CTS trades, which has not been clarified in the reply by the Directorate General of Training. As the word “relevant trades” used in the eligibility criteria is not explained in clear words, the Appellant prayed to the CIC to direct the Respondent to give clear cut clarification regarding the term used “Relevant Trades” in the eligibility criteria. The CIC observed that the requisite information should have been disclosed upfront or atleast through FAQs with the concerned piece of information. An Advisory under Section 25(5) of the RTI Act was issued to the Respondent Public Authority to firstly, disclose the meaning of “Relevant Trade” upfront on their website and secondly, to create a FAQ section on their website and also keep it updated so as to make it easy for a layperson to get frequently sought information and relevant orders/circulars.
Comments
Proactive disclosure by the public authority relieves the burden of RTI Applications, which are filed merely seeking clarifications and not any specific record. It is also in tune with the requirements of Section 4 of the RTI Act.

New statue of justice in Supreme Court library

New statue of lady justice is a new dawn for the judiciary in India as justice is no longer blind folded like till now. Hope this also changes the mindset of judges and they work for quick and affordable justice for people instead of the government and its superiors. Quick Justice is needed for all without any discrimination.

Marital Rape - a case of misplaced priorities

In a country where, unfortunately, horrendous crimes against women continue to shock the conscience of the nation repeatedly, the matter of "marital rape" is taking centre stage of discourse. This is a case of misplaced priorities. What is needed is to ensure that crimes against women are punished quickly and severely, rather than seeking to clog an already strained judicial system which is groaning under pending caseload of crores of cases by creating new needless classes of offences by blindly aping the west disregarding Indian society which will do nothing but destroy the institution of marriage by giving a handle to any spouse who is temporarily disgruntled for any reason to file criminal cases and enhance the opportunity to the unscrupulous in the police to misuse such law for corruption.

Time to abolish Income tax offices

There is a very strong case to abolish Income tax offices in India. Collection is automatic and through computerized system. There is a very high cost of collection of Income tax. There are too many officials manning positions. Now that these ITOs are computerized, there is a case for downsizing this department. The whole set up can be run with skeletal staff.

Payment of fee for application to be considered as valid

The PIO submitted before the CIC that the instant RTI Application was filed without payment of the requisite fee and therefore, the same was treated as incomplete. On being asked by the CIC to provide any proof regarding the fee paid by him towards the instant RTI Application, the Complainant failed to furnish any proof for the same. The CIC observed that the Complainant has lodged the instant RTI Application without payment of the requisite fee and the same has also been informed to the Complainant by the PIO. Hence, the CIC held that the present petition is not maintainable being infructuous.
Comments
An applicant must adhere to the essentials of the RTI Act and not only pay the required application fee, but also retain the proof of payment of fee.

Data Compilation

Can data be compiled as to how many IRS officers have resigned from their service in the past ten years? It would be very interesting to know. Similarly, how many IAS officers have been arrested for corruption in the last ten years?

Promotion and transfer in judiciary

The Central government on the recommendation of the Supreme Court promotes and transfers judges of High Courts. There are some glaring cases where Judges are promoted for a few days and transferred to another State. In such cases, the public and the respective Court hardly gain. He/ she is left with little time to implement his vision in the respective Court. Further, the individual Judge is also disturbed especially when he/ she is left with only a few days for superannuation. Since there appears to be opaqueness in this system and burden on exchequer in paying transfer allowances as also arranging protocol for honourable judges/ chief justices of High Courts, this needs a review. In the government policy governing promotion and transfer matters, the officer is adjusted at the same office or station, as far as possible, if superannuation period is short. The views may not be construed as affront to the judiciary but are only observations of a citizen of this country.
