Airport accident

The Civil Aviation Ministry should take a serious note of the mishap at Delhi International Airport leading to the death of one person and injuries to six. The safety rules must be reviewed and all such structures at airports should be inspected. The safety of passengers must be the government's top priority.

Agree with the views

I fully agree with the views of A K Saxena. Parliament should defer the implementation of new laws and ask the Law Commission to study the issues raised in the note by Saxena.

“Penal laws anomaly, Supreme Court and new Parliament”

The three new criminal laws: ‘Bhartiya Nyaya Sanhita’, ‘Bhartiya Nagrik Suraksha Sanhita’ and ‘Bhartiya Sakshya Adhinium’, the reworded versions of existing fundamental criminal laws IPC, CrPC and the Indian Evidence Act (colonial legacy) as per gazette notification, will be effective from July 1, 2024. The prevailing three criminal laws have been in operation for over a century and have received interpretations from various courts including the Supreme Court. Some legal luminaries have, in a letter to the union law minister, have sought deferment of new laws beyond July 1.2024. Some logical questions arise in our minds. These merit careful consideration. These are : (a)Will the change-over reduce cost of litigation to the accused and save litigation time; (b) Will the new dispensation reduce the large backlog of pendency in the already overburdened judiciary, running into crores of cases; (c) More importantly, could the two systems of criminal justice(old and the new)operate concurrently. All pending cases, filed under old system, are at different stages of litigation (d)Could the substantive laws, IPC, India Evidence Act, be applied retrospectively; (e) The procedural laws could possibly be applied retrospectively, provided they impact the accused adversely. These are matters for legal scrutiny; (f) Could the accused live with a sense of certainty and security about their Right to life and liberty, not knowing which stream of law will govern them. Utter confusion, chaos. More litigation, more cost to the accused, more delay; (g) What will be the cost of infrastructure needed to upgrade the system of delivery of criminal justice? Has any thought been given to the above questions ; (h)Will the dichotomy, as stated above ,be able to stand the scrutiny in the Supreme court; (i)Some bright legal minds have already expressed concern about the haste in which the bills were passed in the last Parliament; (j) Could the gazette –notified new penal laws be referred to the new Parliament for further discussion, one wonders? Much will depend on the stand taken by the Supreme Court on the validity of new penal laws, the ruling political dispensation and the new Opposition. No litigant has ,so far, approached the Top court in the matter, possibly awaiting reaction of the Union of India.

Leak of NEET papers a blot on part of NDA Govt

How the NDA Government should tackle corruption/ corrupt practices. Conducting General Elections at all India level or conducting all India level entrance examinations like NEET, etc. is a difficult task. The recent example of leak of papers of NEET is a blot on the part of the NDA Government. The opposition parties take advantage of such incidents and are holding the NDA Government responsible for this. After conducting such an entrance test, cancellation and re-test is a costly affair. Corrupt practices are still prevailing in India. To avoid such corrupt practices, all officers of the Ministry directly involved (right from Secretary of the Ministry to the ground level officials) should be held responsible. There should be a column in their annual confidential reports where the number of cases of leakage of test papers or corruption cases should be mentioned besides appropriate action against them, right from the ground level officials to the Secretary of the Ministry. Nowadays the higher officials go scot free when they fail in their responsibility to select appropriate officials to handle such exams. Government should rethink their punishment policy without which such incidents will take place again and again.

Union Govt should deal with corruption with iron hands

It is fortunate that in the third term of the Modi cabinet, some of the non-performing ministers are taken to the back foot and new, experienced faces are given the opportunity. It is needless to mention that states like West Bengal and Odisha, which are run without any vision except the misuse of public money for vested interests, need to be dealt with iron hands by the Union Government.

A law needed to control burgeoning population

India needs a new law in order to ensure that the country's population problem is solved. No one having more than two children should be allowed to vote.

Decentralisation of NTA

The mismanagement of NEET etc exam by NTA has been in news for some time. One of the reasons for this is the centralised operation from its office in NOIDA. It is impossible to have a close watch on various agencies, persons etc required for conduct of such exams throughout the country. NTA should open its regional offices ( at least eight) in other cities across India. The regional officer should be made responsible for finding proper place, persons etc. for conduct of exams. They should collect the answer sheets etc, in their region and send it to the Head Quarters for further processing. This may help in minimizing the chances of leakage etc. CBSE has done this and it is working well.

To refresh bureaucracy is critical task for Modi

A critical task for Modi 3.0 is to refresh bureaucracy. And precisely, this is at the top of the agenda. Competency mapping, Bharat Talent Pool, Karmayogi course, National Training Week, civil service exams review are a few of the steps mentioned in the first 100-day agenda for the new government. Read more about it in this issue!

Freebies fail to translate into votes in Karnataka

The Lok Sabha election results yielded surprising outcomes for various political parties. However, the Congress party in Karnataka faced a setback as their freebies did not lead to electoral success. In the 2023 assembly elections, Congress achieved a notable victory, largely credited to the innovative freebies provided to different sections of society. While the increase from one seat in 2019 to 9 seats in 2024 is significant, the party's failure to substantially grow its representation despite holding a strong majority in the state is a major setback for the Congress.

Sending politicians to jail for graft perfectly fine

As a supporter of BJP, I am once again disappointed that Modi chose to surround himself with sycophants, who mislead him by praising all his commissions and omissions. Sending politicians to jail after they are convicted for graft is perfectly fine. However, locking them up for years pending trial will generate sympathy for them in public to the detriment of BJP. Major factor for Jagan's loss is sending Chandra Babu to jail just to satisfy his whims. Arrogance is another trait displayed by the sycophants. Further a jerk in the bureaucracy took out an uncalled for circular threatening government servants with strict implementation of biometric attendance. Is this required at this stage for the Modi government to open another front of confrontation with a loyal voter base of government servants who voted for 7 out of 7 in the Capital?

Priyanka to contest from Wayanad

Congress leader Rahul Gandhi will remain an MP from Rae Bareli seat in Uttar Pradesh and will resign from Wayanad seat in Kerala. Priyanka Gandhi has been declared the candidate by the Congress party for the by-election on the Wayanad Lok Sabha seat. Priyanka has said that she will not let the people of Wayanad feel the absence of Rahul Gandhi. If Priyanka wins, it will be interesting to see how she raises issues of public interest in the House. While Sonia will be a member of the Upper House, both her son and daughter will become members of Lower House in the event Priyanka registers victory.

“NEET UG 2024 conundrum"

Paper leakages, time-lags in conducting the examination, awarding grace marks as compensation, extortions of money from the candidates for facilitating qualifying, sting operations and so on. The case has all the ingredients of a mega scam. Unfortunately, the National Testing Agency (NTA) has been in the denial mode, ostensibly trying to protect the alleged wrong-doers. No arrests of officials, not even suspensions, have been ordered, till date. NTA’s role has been unprofessional, dubious, suspect from the beginning.NTA has a lot to learn from a professional body like the UPSC. Needless to mention. The mega- scam must be having inter-state/country-wide ramifications , involving powerful mafia. It would be in the fitness of the things, if in these circumstances, the case is subjected to a Supreme court-monitored inquiry by the CBI. Further, as the integrity of the examination has been compromised, it may be declared cancelled, sooner than later, and re-conducted afresh. This is the demand of the public-at-large including the aspirants. The public feels greatly saddened by the sufferings undergone by genuine aspirants for the hard labour they put in. But, the ends of justice will have to be met. The verdict of the Supreme court, will, no doubt, have to be honoured. Stormy sessions may be ahead in the Parliament. The ruling dispensation will have much to explain.
